my husband and i have been separated for over 3 years but we’re still married. he’s currently incarcerated and is filing for divorce but he wants joint custody.. would a judge actually grant him joint custody even though he has five more years to serve?

Can I divorce my husband with out him signing if we have a child?

JENNIFER J asked:
I have been legally separated from my husband since 2005. He has succeeded in not signing divorce papers every chance he gets, for one reason or another. We do not have property to dissapate and I just want a divorce, nothing else. He comes up with reason after reason not to sign the papers. We have a 4 year old son, but are not fighting over custody, it’s not even an issue. I just want a divorce, and have been patient for threee years. Can I get it without him agreeing?

Mrs. Miller asked:
My husband and I have been together for 3 years, but have only been married for 7 months. We have come to the mutual decision to get a divorce. We have no money to split, and we have openly agreed to have joint custody of our son. We have no idea how to go about getting this taken care of, and we really don’t want to have to go to court to get it done. Is there any way that we can just go to fill out a simple form and get divorced without any kind of hassle with court?

My wife filed divorce 2 years ago. The judge ordered 50/50 custody and ordered me to pay child support. Since then, we’ve been working things out and neither of us have persued completing the divorce in over a year.

How do we stop the divorce, and do we have to go back to court to stop the child support?
Also, if we split up again will he have to fight for custody all over again?
