If a person files a Petition for Dissolution of Marriage and the end result from the court is Dismissed without prejudice for lack of prosecution… what does that mean? Is the person divorced? The case was on the court’s Inactive Calendar for over 60 days. If it does not mean the divorce was final, will the person have to file a new petition for Dissolution of Marriage?

I would like to know if anyone can help me find out more on the child custody laws in West Virginia. The child was abused by one or both of the parents and I’m looking into trying to gain custody. I live in NC and I’m the aunt of the child. I can’t find anything on the internet to help me with what I need to know or to direct me on how I need to proceed. I’ve already met with the social worker on the case and she is currently working on getting paperwork ready for a home study for my husband and I. I just need to know more when it comes to how long we would have the baby if granted custody. What happens after that?

I can’t find any laws that I understand about this. Say that, several years after the divorce, the father is returning with intention of getting sole custody. He has emotionally abused his child in the past, though she never went to therapy for it, and he has a history of not paying child support or using his child support checks as blackmail to get his ex wife or daughter to agree to what he wants. And he has the stable money out of both the parents. Are there any laws that could be dragged up that would absolutely keep him from gaining sole custody?

He caled me and said he was too busy and do not come over there. He has visitation on weekends, but I was willing to work with him on other times. He does not respond. What would you do? I had my child custody finalized in Indiana prior to marrying/moving to Hawaii to be with my Army husband. We’re getting ready to move to our next final destination which is back to the mainland. Does anyone know if in the courts of Indiana, you are required to file an intent to move with every move? Also, can a change of jurisdiction be requested once we reach our final destination since it’s outside of Indiana? This involves a young child so there will be years of potential updates required and neither the father nor I reside in Indiana.
