Divorce, and home and custody issues?
cpa711 asked:
my husband left over a month ago from our home, I have one child with him. I have lived in the state of Oklahoma for two years now, but I have no family here, I understand if I move back before any divorce is filed it can fire back. I also have two children from a prior relationship who father is in Texas. He has threaten me that I am not going to take his daughter away, and if I cannot afford to pay the house than I need to move out. He makes more money than I do with his military benefits, I cannot afford an attorney either. What options do I have with the house that is all I have to live, will I lose it ?
he is a Vetern so he gets $700.00 extra a month, the house is under both our names. I can afford it but it would be stressful. Can he keep me here in Oklahoma because of my daughter? I cannot file divorce in California for six months by than he will file here. who has the benefit on filing first? Thank you for all your answers.

If there is no order in place, you can move where ever you like. Just keep in mind, divorce proceedings take place where they were filed. You may have to make trips to settle things. If the house is in his name, leave. Get yourself an apartment, stay with friends until you can save money.

i am no expert but my advice would be to move back in with your family for the time being. If you can afford to keep the house then keep it, if not put it on the market. As for the moving thing before the divorce is filed, i dont think it will much matter. You have no family where you are and divorce is a hard time and you need your families help. Good luck. It will all work out in the end im sure.
