Me and my wife have decited to split up (no divorce yet). We are in the united states right now but im leaving to go back to germany next week. My daughter is 4 month old and i was wondering how im gonna start to file for custody in germany while my daughter is over in the united states. My daughter also is a german citizen.     I honestly do not know how the citizenship issues play into this topic.

    My guess is that if you are both German citizens then the US courts would not really have grounds to judge on this matter. I believe that you and your daughter would return to Germany while your wife petitions the German courts for a custody hearing. If you and your daughter are German citizens, and your wife is not, I do not believe that she can keep your daughter in the US while you return.

    I’m not a lawyer, but I do have experience with family law and custody issues. I hope this helps at least a little.
