She just got a divorce but there were no agreements as to who has custody of the child. Her EX makes it hard to get into contact with her and we think he just convinced her of letting him keep the baby without legal process. I suspect psychological abuse since she has a mental condition. As Grandparent of the child I am willing to take custody myself IF there is a way to take legal action.
He and his mother live together and they are both receiving disability checks…

    Of course there is a way to take legal action. Help your daughter file for a custody order in court.

    Get a lawyer.

    Well, normally, the Court will award custody to the mother unless there is a good reason not to.

    You’ll have to start a custody petition in Family Court and see what happens.

    grandparent intervention in Texas is something I have slept/had nightmares about for 4 yrs.
    1. The parents must be split (family no longer intact due to divorce, death, jail
    2. The remaining parent has to be PROVEN unfit.

    Both of these have to be true… and it is possible you might qualify on both. GET A LAWYER.
