My wife is filing a divorce case,child custody, and child support. I am out of the states and don’t know what to do, what proper actions should take place?

    Hired a lawyer, you will be serve divorce papers at some point, then you and your lawyer can go over the paperwork and decide what actions are the best for you

    If she can’t serve you then she can’t get a court appearance. And no one can serve you out of the country. But to be on the safe side call a lawyer back home and seek their advice.

    Since she can’t serve you, she may petition the court to do a newspaper notice. You need to appoint someone reliable in your family to represent your interests, by way of a Power of Attorney. You don’t want to hire any attorney, however interviewing a several might be limiting. It could be done use Skype Video Conference. Your representative will be there, however you will do the talking. Here’s what you need to prepare.

    The biggest problem is gathering needed documents, however your representative will have the power to contact banks and other institutions. Anything in your wife’s possession may need to be subpoenaed, if she desires to be uncooperative. If she is, that should be noted in your daily journal.

    You should be recording any conversations you have with her. Getting a Skype account will help with that as they have an add-on app for doing this. If she lives in a state where it’s illegal to record calls, than you can only legally record your calls to her, in order to be used as evidence. There is no international law forbidding you from recording your own outbound calls. You will learn about that in the Getting Started link above.
