spkywndr asked:

I heard somewhere (depending on the state) that if one spouse is having an affair, the faithful spouse does receive more in the divorce. Does anyone know if this is true and if so, how to discover details in individual states?

Depends on the state, but most are no fault states.

I can’t speak for every state, only the state of GA…

It doesn’t matter if you are caught screwing around on the courthouse lawn, as long as there is no direct danger or negligence of your children!!

That came straight out of a judge’s mouth when my friend was going through his divorce….

    Sad isn’t it????

Usually the only effect cheating has in a divorce settlement is if the female is cheating she will not get alimony.

Most states are no fault, so no. Honestly I don’t think it should either. Cheating is terrible yes, but property division is a legal matter, not a reflection of your character.

In some states, if you can prove the adultery, you will get your divorce faster.

You can sometimes use the adultery as leverage in a property settlement agreement/alimony agreement. I.e. you will proceed with a no-fault divorce if he gives you favorable terms…otherwise, you’ll proceed with a fault divorce and air his dirty laundry in court.

You will not automatically get more, no.
