NurseGodiva asked:

I filed for divorce in Nov of 2007 and never filed for final judgement. I was told by my estranged husband that we needed to file for final decree before this December. If not we would have to repeat entire process. Anyone ever heard of this? I live in Louisiana.

Call a lawyer in your area. Yahoo answers is not a legal service.

What? I am lost. You filed for a divorce 2 years ago…did you get a court date? I don’t believe anything was filed.

I submitted my original petition for divorce in Texas on July 8th and was told by the court that if I had not completed the process by November 5th then the petition would be dismissed.

Laws vary from state to state but you can get the answer you need by calling the court clerk’s office in which it was filed. You’ll need the case number that was assigned to it.

I’m finding it hard to believe that they would give you two years to do this, when Texas only allows 120 days (and sixty days of that is a mandatory waiting period). My guess is, you are already in a situation where you need to start all over.

If you don’t think you can be ready in time, consult with an attorney about getting an extension or re-filing. You should not allow an imminent deadline to influence an unjust compromise. But if you have already arrived at a mutually acceptable agreement, then quit dragging your feet.
