I know that an ex-spouse is entitled to part of her husbands social security benefits upon retirement. What I need to know is does the 10 years count from the date of filing, or the date of the final divorce decree?

Read these FAQ’s and see if they apply to your situation. Or you can just call SSA and get the info you need.

the 10 year rules starts from the date of marriage, it has nothing to do with the filing or divorce decree, if you are legally married for 10 years you are entitled

You must be married for 10 years beginning with the date you married and ending with the date of the final divorce decree.
