Rhiannon B asked:

After the first of the year I’m leaving my bf. My best friend and I are going to get a place in Nevada, I wanted to know if I can file for full custody as soon as I get there? Or do I have to wait to be a resident?

Whoa, sneaky plan, heh? Check the laws in Nevada. You might have to file in the jurisdiction in which your boyfriend lives.
He needs to be able to be in court and asserts his rights as well.

You better get custody before you leave with the permission of the court to move your child out of state and away from the father. Without you having custody, you might be looking at some major problems if you leave the state with the child and no permission from the father and the court. If you move without custody, the father can then petition the court for it and you will have to bring the child back until it is all sorted out.

Contact a lawyer. In some states if you file before you leave, the judge can force you to stay in the state until it’s decided. In some you have to live in a state for several months to establish your residence before you can file. It just depends. I’d call a local lawyer and also one in NV and ask. They can give you that info for free and over the phone.
