My life is now complete PWKRJC! asked:

I am wanting to go to court so I can have a paper in front of me telling me when my Son will be with me and when my Son will be with his Father because I cant stand not knowing when my Son’s Father is going to call and ask for him again. So my question is when you went to court for custody what was the outcome how much did you have your child and how much did the other parent have them? I know that prices are different everywhere but I would like to know how much you had to pay for a lawyer. Thank you for your time.

you don’t necessarily need a custody order.. just a visitation schedule. That way your ex can’t just swoop in whenever he feels like it and take your son. It’s much easier if you have in writing something like Every other weekend from Friday at 4PM to Sunday at 4PM That way there are no questions about it.

In Australia you can go through Relationship centers or then mediation (RDM) to get a parenting plan that is then sealed by the court. This is the best way if there is minimal conflict. Very good idea to get something in writing, children need consistency and you need to be able to plan your life and your child’s.
If you are low income you can apply for legal aid. Definitely get legal consultation before you do anything and i’d go to law sights, single parenting associations etc. and get as informed as possible about your rights and obligation.
Good luck, i hope it goes well:)

Well if you live in the U.S. you DO NOT have to hire a lawyer.

Call your local Attorney General office (child support office). Fill out an application, turn it in, and within a short amount of time you will get an appointment to go to your child support hearing. Usually, if he doesn’t contest it or ask for a paternity test, it should go smoothly and be done that same day.

The court will be the one to set up a visitation schedule. Usually, if you are the custodial parent, then you will have the child the majority of the time. The non-custodial parent (usually the father) will have the child (usually) every other weekend from friday afternoon to sunday afternoon. Sometimes they will let the father have the child an afternoon (for a few hours) during the week, say Wednesday afternoon from 4-7 or so.

There is absolutely NO reason to hire a lawyer, unless he tries to fight you for custody. But usually the only way he can get custody is if there is ‘probable cause’ to take the child away from his/her natural mother.
